These services are provided both online and offline and include, but are not limited to, business consulting, sales consulting, marketing consulting, HR consulting, corporate training, online courses, and e-commerce solutions.

By accessing our website or mobile application (collectively referred to as the “51K App”) or using any of the 51K Services, you signify your agreement to these Terms of Use. If you do not agree to these terms, you are required to refrain from using the website, application, or services. By continuing to access or use the 51K Services and/or registering for an account, you confirm that you have read, understood, and accepted these Terms of Use, along with any additional terms and conditions that may apply to specific services. For the purposes of these Terms, the term “51K” refers to www.51kgrowthhub.com and its associated mobile application, owned and operated by 51K Growth Consulting and Training LLP.

51K Growth Hub reserves the right to modify, suspend, or terminate any of its services (or specific features thereof) at its sole discretion and without prior notice. This includes revising these Terms of Use and making changes to pricing or features. Any significant updates to the Terms will be communicated through our platform. Your continued use of our services after such changes indicates your acceptance of the revised Terms.

• Introduction

• Our Purpose

Our services empower individuals and organizations to enhance their skills and capabilities through expert consulting, coaching, training, online courses, forums, groups, downloadable materials, blogs etc., We provide both live and pre-recorded sessions, accessible through our website / 51K App. Additionally, we sell related products through our e-commerce store, which may include books, office stationery items, mobile phones, laptops, desktops, and other items as part of partnership agreements or affiliate relations with various companies globally.

 

• Legal Agreement

These Terms of Use ("Terms"), together with our Privacy Policy, Cancellation and Refund Policy and any additional terms for specific services, form a binding agreement between 51K Growth Consulting and Training LLP ("51K Growth Hub," "we," or "us") and you ("User" or "you"). These 51K Terms, and your use of the 51K Services, do not, and shall not be construed to create any partnership, joint venture, employer-employee, agency, or franchisor-franchisee relationship between 51K and you.

 

• User Accounts

To access most of the services provided by 51K Growth Hub (as available from time to time), including but not limited to online courses, consulting, training, blogs, forums, and groups, you must first register and create a user account ("User Account") via www.51kgrowthhub.com or the 51K App. During the registration process, you are required to provide accurate and complete information. It is strongly encouraged that you use your own contact and billing details (or your company’s, as applicable), including a valid email address. This information may be used to identify and verify the true ownership of the User Account and any content associated with it.

As the account holder, you are solely responsible for safeguarding your login credentials and for all activities conducted under your User Account. You must not share your login details with others. Any unauthorized access or use of your account must be reported to us immediately. If a third party gains access to your User Account and performs actions available to you, such actions will be considered to have occurred on your behalf. By using the account, you agree that any activities undertaken in your name are your responsibility, whether or not specifically authorized by you. 51K Growth Hub will not be held liable for any loss or damage resulting from unauthorized access to or use of your User Account.

For each User Platform created under a User Account, 51K Growth Hub will consider the person or entity whose email address is listed in its records as the owner of the User Account and all associated platforms and content. In the event of a dispute regarding account ownership, 51K Growth Hub reserves the right to determine ownership at its sole discretion. This determination may involve an internal review or a request for supporting documentation, such as government-issued identification, business licenses, or other relevant evidence. If a determination cannot be made to our satisfaction, we may suspend the disputed User Account until the involved parties resolve the issue. During this time, 51K Growth Hub shall not be held liable for any resulting inconvenience, loss, or damage.

If any Paid Services were purchased through a User Account, 51K Growth Hub may deem the owner of the User Account to be the person or entity whose billing information was used for the transaction ("Billing Information"). This ownership extends to the relevant User Platform and any associated content created under the Paid Services.

• Your Obligations

By using our services, you confirm that you:

• Are at least 18 years old or the age of majority in your jurisdiction.

• Have the legal authority to enter into these Terms.

• Will comply with all applicable laws and regulations.

• Are not prohibited from using our website/51K App or services under any laws applicable to you.

  • Buying Terms

When purchasing an item, you agree that:

• You are responsible for reading the full item listing before making a commitment to buy.

• You enter into a legally binding contract to purchase an item when you complete the checkout payment process.

• You are responsible for ensuring that the details provided during the purchase are accurate.

  • Prohibited Activities

When using 51K Services, you agree not to engage in the following prohibited actions:

• Unlawful or Fraudulent Use

  • You must not use 51K Services for any unlawful purposes or to engage in fraudulent, unethical, or deceptive activities.

• Unauthorized Access and Use

  • You must not attempt to gain unauthorized access to any part of the 51K platform, user accounts, or connected networks.

  • You must not disable, circumvent, bypass, or interfere with security measures or features of the platform, including through hacking, password mining, or other illegitimate methods.

• Intellectual Property Violations

  • You must not copy, modify, create derivative works from, reverse-engineer, distribute, or misuse any part of the 51K platform or its content without prior written permission.

  • Do not upload or share content that infringes on intellectual property rights or violates any laws.

• Benchmarking and Competitor Use

  • You must not use 51K Services to benchmark, reverse-engineer, or develop competing products or services.

• Harmful or Disruptive Behavior

  • You must not engage in any activity that could harm 51K Growth Hub, its reputation, or its users, including spreading false information or engaging in abusive behavior.

  • Do not interfere with the platform’s operation, including using bots, scripts, or automated systems to access or manipulate the platform.

• Spamming and Unethical Marketing

  • Avoid engaging in any form of spamming, phishing, fraud, or pyramid schemes using 51K Services.

  • You must not use the platform for chain letters, unsolicited mail, or other unethical marketing practices.

• Violation of Privacy and Data Collection

  • You must not reverse look-up, trace, or attempt to trace another user to collect their personal data without their explicit and informed consent.

  • Unauthorized collection or harvesting of personal information from users is strictly prohibited.

• Misuse of Trademarks and Branding

  • You must not use the '51K' name, branding, or trademarks in unauthorized ways, such as creating domain names, search engine keywords, or other materials that mimic or misrepresent 51K.

• Unauthorized Display or Distribution

  • You must not publish, mirror, frame, or deep-link 51K content on unauthorized platforms or media.

  • Avoid altering or removing copyright notices, watermarks, or proprietary signs from any 51K materials.

• Compliance with Laws

  • You must comply with all applicable local, national, and international laws when using 51K Services. Failure to do so may result in termination of your account.

• Unauthorized Content Distribution

  • You may not sell, license, rent, or otherwise exploit 51K content or services for commercial purposes unless explicitly permitted in writing by 51K.

• Consequences of Non-Compliance

  • Any violation of these prohibited activities or misrepresentation may lead to the suspension or termination of your account, without notice or refund, at the discretion of 51K.

• Content and Intellectual Property

  • Your Content

By uploading any content (including but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text, or literary works) to the website, you represent and warrant that you either own all relevant rights to the content or have obtained the necessary licenses to upload, transfer, and share it. You consent to the public display of such content on the website and grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute the content as required to deliver our services.

You further confirm that the content is not harmful, defamatory, or unlawful. You accept sole responsibility and liability for your content, including any consequences arising from its storage, distribution, publication, or other uses related to the 51K Services.

  • Our Intellectual Property​

All rights, title, and interest in and to the platform, content, tools, and branding of 51K Growth Hub, including but not limited to software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all associated intellectual property, are the exclusive property of 51K Growth Hub.

Subject to your full compliance with these Terms and timely payment of applicable fees, 51K grants you a non-exclusive, non-transferable, non-sublicensable, and revocable limited license to access and use the 51K Services and Licensed Content solely for personal or organizational use in accordance with these Terms.

This license does not permit you to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works based on the 51K Services or any related materials, except as explicitly authorized in writing by 51K. No provision in these Terms shall be construed as granting you any additional rights to the intellectual property of 51K Growth Hub beyond those expressly provided herein.

• Licenses Given to Us

To the extent a license is required under applicable laws and regulations, you also grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to: (a) access, upload, copy, make and display adjustments, train our software tools, duplicate, and perform any other technical actions and/or uses with your Input and Output in order to: improve 51K Services; review Inputs and Outputs for compliance with applicable laws and enforce the Terms as required to provide our Users with 51K Services.

 

• Fees and Payments

  • Paid Services

The use of certain 51K Services may require payment of specific fees, which will be clearly disclosed to you prior to purchase. All fees are generally payable in Indian Rupees (INR) and are exclusive of any applicable taxes unless explicitly stated otherwise. By purchasing any 51K Services, you agree to pay all fees associated with your selected services. Additional charges, including but not limited to taxes and transaction fees, will be applied as indicated during the checkout process. If you wish to receive or use the Paid Services, payment of all applicable fees is required in advance.

51K reserves the right to change its fees at any time, at its sole discretion, and without prior notice. The prices for our services or products are listed on the website or, where applicable, on the affiliated company’s platform, as specified where our name has been registered as an affiliate. Additional information regarding pricing and applicable sales taxes is available on the payments page. Fees for services, along with any additional charges incurred during your use of the services—such as taxes and potential transaction fees—will be charged on a monthly basis to your selected payment method.

51K may, at its discretion and without prior notice, modify, suspend, or terminate any services, service features, or pricing. Furthermore, 51K reserves the right to impose limits on the availability of services or to discontinue services permanently or temporarily for any reason, or without providing a reason, without incurring any liability.

  • Invoices​

51K will provide an electronic invoice or credit memo (“Invoice”) for any fees paid or refunds issued by or to 51K. Each Invoice will be generated based on the billing address provided during your transaction and made available to you via your User Account or email. To comply with applicable local laws, you may be required to provide specific personal information, as outlined in our Privacy Policy, for the issuance of the Invoice.

Please note that the Invoice provided may not meet all requirements of your local jurisdiction. In such cases, the Invoice should be considered as issued for pro forma purposes only and may require additional documentation to comply with your local legal standards.

  • Subscription Auto-Renewals​

For subscription-based services, your subscription will automatically renew at the end of each billing period unless you cancel it. Renewal fees will be charged to the payment method associated with your account. You may opt-out of automatic renewal at any time through your account settings.

You are solely responsible for verifying and ensuring the successful renewal of any 51K Services you use, regardless of whether those services are subject to automatic renewal. 51K is not liable for the discontinuation of any services previously purchased by you, including instances resulting from cancellation, failure to process recurring payments, or the absence of automatic renewal for the service in question.

By using 51K subscription-based services, you acknowledge and agree that you will have no claims against 51K for any disruptions or discontinuations of services arising from these circumstances.

  • Refund Policy​

For any undamaged product, return it with included accessories and packaging along with the original receipt within 14 days of receipt for an exchange or refund. Refunds will be issued to the original payment method. Note that returns are only accepted in the country where the product was purchased. Refunds for services are subject to the specific refund policy provided at the time of purchase. Please review the terms for each service before making a purchase.

 

• Cancellation

You may discontinue the use of and request the cancellation of your User Account and/or any 51K Services at any time by following the instructions provided within the 51K Services platform. The effective date and time of cancellation will be the date and time at which you successfully complete the cancellation process as outlined. For Paid Services, the effective cancellation date will coincide with the end of the current subscription period.

Failure to comply with any provisions of these Terms, including non-payment of fees, grants 51K the right to suspend your User Account, User Platform (or specific features thereof), or any associated 51K Services until full payment is received. In certain cases, 51K may cancel your User Account or related services entirely.

​

If your User Account or associated services are canceled—either at your request or at 51K’s discretion—this may result in the loss of access to content, features, or capacity tied to your account. Such losses may include User Content, End User data, usage data, and any other information or registrations associated with the affected services.

Upon termination of your User Account or User Platform, 51K reserves the right to delete all data associated with the account as part of its standard operational processes. Once deleted, this data cannot be recovered under any circumstances.

• Warranty of Claims

For valid warranty claims, we will repair or replace the defective product. If repair or replacement is not possible, you are entitled to a full refund upon prompt return of the product. Shipment costs for repaired or replaced items will be covered by us, while return shipping costs will be your responsibility.

 

We make no warranties regarding our services, including their quality, reliability, security, compatibility and conditions. There are risks in using our services or anyone else’s services. You accept such risks.

 

• Limitation of Liability

To the fullest extent permitted by applicable law in each jurisdiction, 51K, including its officers, directors, shareholders, employees, affiliates, and agents, shall not be held liable to you for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages. These include, but are not limited to, damages arising from:

1. Errors, mistakes, or inaccuracies in any content provided by 51K Services;

2. Personal injury or property damage resulting from your use of the 51K Services;

3. Unauthorized access to or use of 51K’s servers, including unauthorized access to personal or other stored information;

4. Interruption, suspension, or cessation of transmission to or from the 51K Services;

5. The use, display, or reliance on any content or user-generated content posted, emailed, transmitted, or otherwise made available via the 51K Services;

6. Events beyond 51K’s reasonable control, including but not limited to internet failures, equipment malfunctions, electrical power outages, strikes, labor disputes, riots, civil disturbances, insurrections, shortages of labor or materials, fires, floods, storms, earthquakes, explosions, natural disasters, acts of war, terrorism, governmental actions, judicial or regulatory orders, or the non-performance of third parties; and/or

7. Loss of use, data, profits, goodwill, or other intangible losses arising from the use or inability to use the 51K Services.

You expressly acknowledge and agree that these limitations of liability represent a reasonable and fair allocation of risk, forming a fundamental part of the consideration for the services provided by 51K. These limitations will apply even if 51K has been advised of the possibility of such damages.

• Indemnity

You agree to defend, indemnify, and hold harmless 51K, along with its officers, directors, shareholders, employees, affiliates, and agents, against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including reasonable attorneys’ fees) that arise from or are related to:

1. Your violation of any provision of these Terms of Use or any other applicable 51K Terms;

2. Your infringement or violation of any third-party rights, including but not limited to copyright, access rights, property rights, or privacy rights, resulting from your User Platform, User Content, or use of the 51K Services, including any actions undertaken by 51K Services on your behalf; and

3. Any other claims that your User Platform or User Content caused harm, damage, or loss to a third party.

• Termination

We reserve the right to suspend or terminate your access to our services if you breach these Terms or engage in activities that harm our platform or users. You may discontinue use and request to cancel your account at any time. For subscriptions, cancellations will take effect at the end of the billing period.

 

• E-Commerce Terms

For any purchases made through our e-commerce store, you are responsible for ensuring compliance with all applicable laws and for providing accurate order details. All sales are subject to the specific terms and conditions provided at the time of purchase.

• Affiliate Program Terms and Conditions

Welcome to the Affiliate Program of 51K Growth Consulting and Training LLP! By joining as an affiliate, you agree to abide by the following terms and conditions. These terms are designed to maintain high standards of quality, integrity, and professionalism in promoting our products and services.

​

By participating in the Affiliate Program, you acknowledge and agree to the following:

• You will promote our products and services using only approved materials provided by 51K Growth Consulting and Training LLP.

• You must adhere to branding guidelines and avoid any misleading, false, or inaccurate representations.

• Commissions will only be earned on qualifying sales tracked through your unique referral link.

• You will comply with our commission structure, payment terms, minimum payout thresholds, and applicable tax obligations.

Failure to adhere to these terms may result in removal from the program and forfeiture of any earned commissions.

1) Eligibility and Enrollment:-

• Applicants must complete the affiliate application process and receive approval from our team.

• Affiliates must be at least 18 years old.

• Affiliates are not employees or distributors of 51K Growth Consulting and Training LLP; their role is limited to promoting or sharing links for our products and services. Commissions are earned only when successful sales are generated through these links.

• 51K reserves the right to approve or reject any application at its sole discretion.

2) Affiliate Responsibilities:-

• Affiliates are responsible for promoting 51K’s products and services using the official links, banners, and marketing materials provided by 51K.

• Affiliates must comply with branding guidelines and avoid deceptive practices or false claims.

• Affiliates are prohibited from engaging in unethical practices such as spamming, unauthorized pop-ups, or incentivizing clicks.

3) Affiliate Links and Tracking:-

• Each affiliate will receive a unique referral link for tracking purposes. Only sales made through this link will qualify for commissions.

• 51K does not guarantee 100% tracking accuracy due to factors such as browser settings and third-party interference.

• Sales of free services (For example, free sessions, free courses etc.,) will also be recorded, even if the commission is zero.

• The tracking cookie duration is 60 days.

• Transactions involving self-referral, self-purchase, or affiliate purchases using personal coupons will not qualify for commissions.

• Customers who purchase through an affiliate’s link and subsequently sign up as affiliates will become part of the original affiliate’s downline. The original affiliate will earn an additional 5% commission on all future sales made by the new affiliate using their referral link.

4) Commission Structure:-

• Commissions are based on net sales (total sales minus taxes, discounts, returns, chargebacks, shipping fees, and other adjustments).

• Specific commission rates, eligibility criteria, and payout thresholds will be communicated upon approval and may be updated periodically.

• Commissions are subject to a 30-day holding period before becoming payable.

• If a customer cancels their order or receives a refund, the related commission will not be paid, or it will be adjusted in future payouts.

5) Payment Terms:-

• Commissions will be paid on a monthly basis, provided the affiliate meets the minimum payout threshold of INR 1,000.

• Payments for commissions earned in a given month will be made on or before the 5th of the following month (e.g., commissions for October 2024 will be paid by November 5, 2024).

• Payments will be made via PayPal, bank transfer, or other options selected during enrollment.

• Transaction fees, if any, are the affiliate’s responsibility.

• Tax Deducted at Source (TDS) or other applicable deductions will be made in accordance with Indian tax regulations.

6) Prohibited Activities:-

• Affiliates may not bid on keywords or run advertisements that directly compete with 51K’s brand keywords or website.

• Affiliates must not impersonate 51K’s brand or misrepresent their relationship with 51K.

• Any affiliate found engaging in unethical, illegal, or deceptive practices will be immediately removed from the program, and their commissions will be forfeited.

7)Intellectual Property:-

• Affiliates are granted a limited, non-exclusive, revocable license to use 51K’s logos, trademarks, and promotional materials solely for the purpose of promoting its products and services.

• Affiliates may not modify, alter, or create derivative works based on 51K’s intellectual property without prior written consent.

8) Termination:-

• Either party may terminate the affiliate agreement at any time, with or without cause, by providing written notice via email.

• Upon termination, the affiliate will lose access to promotional materials, and any unpaid commissions may be forfeited if the termination results from a breach of these terms.

9) Limitation of Liability:-

• 51K makes no express or implied warranties regarding the Affiliate Program, its products, or its services.

• 51K is not liable for any indirect, special, or consequential damages resulting from participation in the program.

10) Modification of Terms:-

• 51K reserves the right to modify or update these terms at any time. Affiliates will be notified of changes via email or through the affiliate portal.

• Continued participation in the program after modifications constitutes acceptance of the updated terms.

• Other

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time. 

 

51K may assign its rights and/or obligations hereunder and/or transfer ownership rights and title in the 51K Services and/or Licensed Content to a third party without your consent or prior notice to you. You may not assign or transfer any of your rights and obligations hereunder without the prior written consent of 51K.

 

• Governing Law and Jurisdiction

Any disputes arising from this agreement shall first be resolved through mutual discussion between the parties. If the dispute remains unresolved, it shall be referred to arbitration in accordance with the rules and procedures set forth under applicable law, with the arbitrator appointed by 51K. If the arbitration does not lead to a resolution, the matter shall be submitted exclusively to the jurisdiction of the courts located in Ahmedabad, Gujarat, India.

These Terms, along with the rights and remedies provided herein, and any claims or disputes arising in connection with the services, shall be governed by, interpreted, and enforced solely in accordance with the substantive laws of Ahmedabad, Gujarat, India, without regard to its conflict-of-law principles.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, void, or otherwise unenforceable, such provision shall be deemed severable and will not affect the validity or enforceability of the remaining provisions of these Terms.
